There are currently many different levels of short-term rental restrictions across the county, to varying degrees.
Please see below for a brief outline of the current status in different municipalities:
BRECKENRIDGE
A cap on the total number of licenses of 2,200 was put into effect as of Sept 28, 2021, that went into effect as of November 1, 2021. No new licenses will be offered within the Town of Breckenridge limits until the total number falls below the cap. There are currently over 3,000 existing licenses, to be reduced by natural attrition at the time of sale (licenses do not transfer when a property is sold, the license simply dissolves). SEE HEREfor all current guidelines. There are exemptions for certain buildings within town, which are being updated weekly (Beaver Run is an example)-- must have 24 hr security and phone line.
UNINCORPORATED SUMMIT COUNTY
TO CHECK A PROPERTY'S JURISDICTION WITHIN THE COUNTY, USE THE PARCEL TOOL HERE
1) Use the "Search" feature in the top right, and choose the subject street name and address. Property info will populate at the bottom of the page.
2) Check the "Jurisdiction" section for the designation (green circle). This will tell you what laws and guidelines govern this property.
Anything under the "Unincorporated Summit County" jurisdiction will fall under the County-level rules.
Type I License:
This license may only be obtained by a property owner who lives at their property as their primary residence.
When the property owner is present and offering a bedroom for rent, there will be no limit on the number of nights that the bedroom may be rented annually.
When the property owner is out of town and wishes to rent the entire home, a maximum of 60 nights per year will be permitted.
Type II License:
Property owners with this license can short-term rent no more than 135 nights per year.
The remainder of the year, the property owner may use the residence in any manner which is compliant with all other codes and regulations. For information on long term renting, please visit the Summit Combined Housing Authority and Lease to Locals websites.
Type III License:
An application for a Type III license will only be accepted once a property owner has received approval for a Conditional Use Permit (CUP) from the Planning Department. Conditional Use Permits are discussed in Section 3821.05 of the STR Regulations and Section 12300 of the Land Use and Development Code.
A CUP and Type III license would allow property owners to rent more than 135 nights per year. In addition, lots in excess of 40,000 sq. ft. may request greater occupancy which will be reviewed in the CUP process.
The minimum standards to request a CUP review are differentiated by building type as described below:
Single Family-- Must meet one of the two requirements:
100 ft. separation between all indoor and outdoor occupied spaces on the STR property and all neighboring properties, including but not limited to: residences, attached garages, patios, hot tubs, fire pits, and decks OR
An approved accessory dwelling unit (ADU) on the property that is occupied by a local resident employed in Summit County for a minimum of 30 hours per week
Multi-Family--Must meet all 3 of the following requirements:
Direct shuttle to ski area or transit stop within 100 ft. of property.
Recreational shared amenities, at least 3 of the following: pool, hot tub, sauna, tennis/pickle ball court, game room, or other substantial amenity as approved by the Review Authority
NO CURRENT RESTRICTIONS. This is a HUGE opportunity zone for buyers who wish to short-term rent.
Blue River technically has a Breckenridge zip code (80424), however it is incorporated under its own municipality. It's the closest town to Breck by proximity, so provides an incredible opportunity to provide buyers with worthy second home options while preserving their ability to short-term rent.
BE SURE to check the parcel tool above for Jurisdiction, as some parts of Blue River are "Incorporated Blue River", and some parts are "Unincorporated Summit County". Remember, this is integral in determining which guidelines the property falls under.
FRISCO
NO CURRENT RESTRICTIONS. However there have been discussions about potentially adding certain new constraints. SEE HERE for all current guidelines.
SILVERTHORNE

DILLON
NO CURRENT RESTRICTIONS. SEE HERE for all current guidelines.
PARK COUNTY
